Felony DWI for Multiple DWI Convictions

When someone is arrested for driving while intoxicated, they will be charged with either a misdemeanor offense or felony offense, depending on the situation and whether or not the individual has a record of past DWI convictions.

The third DWI is charged as a 3rd-degree felony in Texas and is punishable by:

  • Up to $10,000 in fines
  • Driver’s license suspension for up to 2 years
  • Between 2 and 10 years of imprisonment

If someone is charged with any additional DWI charges after their third, they could be charged with a 2nd-degree felony, which is punishable by:

  • Up to $10,000 in fines
  • 2-year license suspension
  • Between 25 years or life in prison

In some situations, individuals can be charged with DWI as a felony if other factors were at play.

DWI Causing Injury

If a person arrested for DWI also caused serious bodily injury to another person, they could be charged with a 3rd-degree felony. This crime, referred to as intoxication assault in Texas, could lead to a maximum of $10,000 in fines, between 2-10 years in prison, and driver’s license suspension for at least 180 days, but up to 2 years.

DWI Causing Death

If someone was killed in a DWI accident in Texas, the driver could be charged with a 2nd-degree felony, which is punishable by up to $10,000 in fines, between 2 and 10 years in prison, and driver’s license suspension for at least 180 days, but up to 2 years.

DWI with Child in Vehicle

Drivers can face DWI felony charges if a child under the age of 15 was also in the vehicle. The penalties for this crime are similar to those of 2nd-degree felony charges, but the jail time may be decreased to 6 months.
