Penalties for Multiple DWI Convictions in Texas
Most of the time, a first DWI offense is classified as a Class B misdemeanor. This carries penalties of up to $2,000 in fines, driver license suspension ranging from 90-365 days, and 3-180 days in jail. However, multiple DWI charges are often classified as felony offenses, which carry much higher penalties.
Second Offense DWI
This is considered a Class A misdemeanor and carries the following penalties:
- Fines of up to $4,000
- Jail for 30 days to 1 year
- Driver license suspension for 180 days up to 2 years
DWI 3rd Offense (Third-Degree Felony)
The most common type of felony DWI in Texas is a DWI 3rd Offense. If you have two prior DWI convictions, a third offense will be charged as a felony under state law. In the past, a third DWI would be charged as a Class B Misdemeanor and treated as a first offense if at least 10 years had passed since the date of the last DWI, but this is no longer the case. Today, any prior DWIs can be used to enhance a new charge.
- Fines of up to $10,000
- Imprisonment for 2-10 years
- Driver license suspension for 180 days up to 2 years
The penalties for multiple DWI convictions are harsh. If you are facing a second, third, or subsequent DWI charge, it is important to seek knowledgeable legal representation right away. Our Austin multiple DWI lawyers will investigate the incident, gather evidence to build your case, and aggressively defend your rights in court. We are committed to helping our clients pursue the best possible outcomes in each situation, and will communicate with you from start to finish.
